These Terms & Conditions (“Terms”) describe the rights and obligations associated with wireless services branded as Speak Easy Mobile (“Speak Easy Mobile,” “we,” “us,” or “our”). Speak Easy Mobile is an independent MVNO brand that provides retail wireless services to customers using the underlying infrastructure, provisioning, subscriber management, and network access platform operated by MVN-X, LLC (“MVN-X”), a Wyoming limited liability company.

By activating or using Speak Easy Mobile services, you agree to these Terms and all policies referenced here, including the Privacy Notice and Network Management Policy.

1. Service Relationship Overview

Speak Easy Mobile manages the customer-facing experience, including sales, activation support, and rate plans. All subscriber provisioning, SIM/eSIM activation, network access, billing infrastructure, and core operational systems are provided and controlled by MVN-X, LLC, the underlying service provider.

When these Terms reference “we,” “us,” or “our,” they refer to Speak Easy Mobile in its customer-facing capacity and MVN-X in its service-providing capacity, collectively.

2. Acceptance of Terms

By purchasing, activating, or using Speak Easy Mobile-branded services, you acknowledge that:

  1. You are at least 18 years old or have valid legal authority to enter this agreement.

  2. You agree to comply with these Terms and any additional documents incorporated by reference, including:

    • Speak Easy Mobile Privacy Notice

    • MVN-X Network Management Policy

    • FAQs, service descriptions, and other posted policies

If you do not accept these Terms, do not activate or use the service.

3. Use of Service

You may use the service for:

  • Personal voice, text, and data communications

  • Web browsing, messaging, email, and typical mobile app use

  • Hotspot/tethering consistent with your plan’s limitations

You may NOT use the service for:

  • Illegal or abusive activity

  • Threats, harassment, fraud, or deceptive practices

  • Spamming, automated dialing, or mass messaging

  • Hosting servers or unattended continuous connections

  • Excessive tethering or uses designed to circumvent network policies

  • Reselling, redistributing, or sharing the service as a commercial offering

  • Using unauthorized devices or signal boosters

Speak Easy Mobile and MVN-X may immediately limit, suspend, or terminate service for violations of this Acceptable Use Policy.

4. Devices, SIMs & Activation

To use Speak Easy Mobile service, you must have:

  • A compatible device

  • A valid SIM or eSIM provisioned through MVN-X

If you replace a SIM or eSIM, only the newly activated SIM/eSIM remains active.

SIMs or eSIM activation profiles may expire if not activated within the required timeframe.

5. Rate Plans, Billing & Payments

5.1 General Billing

Rate plans operate on 30-day cycles. Charges may include:

  • Plan fees

  • Add-on packages

  • Taxes, regulatory fees, and surcharges

  • MVN-X cost recovery fees

Usage records may be delayed; charges are applied once data is received from network partners.

5.2 Auto-Renew

You may enroll in Auto-Renew, allowing the payment method on file to be automatically charged every cycle. You must cancel Auto-Renew at least 24 hours before renewal to avoid the next charge.

5.3 Nonpayment

If payment fails:

  1. A retry is attempted.

  2. If still unpaid, service may be suspended or terminated.

  3. Phone numbers may be released if no rate plan remains active.

6. Refunds & Returns

Refund eligibility includes:

  • Refunds for unused plan balances only if the plan was never used, within 7 days of purchase.

  • Partial refunds may be issued at MVN-X’s discretion.

  • SIM cards are not refundable once shipped.

  • Shipping fees are non-refundable.

If a number has been ported out, refunds cannot be issued.

7. Taxes, Fees & Surcharges

Your bill may include:

  • Federal, state, and local taxes

  • Regulatory fees (e.g., USF, TRS, E911)

  • Carrier-imposed surcharges

  • MVN-X cost recovery fee

Speak Easy Mobile and MVN-X collect only those taxes and fees required by law or allowed as pass-through surcharges.

8. Number Portability

You may transfer your number to or from Speak Easy Mobile, subject to compliance with FCC guidelines.
A correct account PIN and other required details must be provided to complete a port-out request.

Service limitations may occur while a port is pending.

9. Network Management & Performance

Speak Easy Mobile service runs on networks provided by MVN-X’s third-party carrier partners.
Performance may vary based on:

  • Network congestion

  • Device type

  • Location and coverage

  • Prioritization policies

  • Network partner rules

High-speed data may be reduced after plan thresholds are met.

10. Emergency Services (911 / E911 / Wi-Fi Calling)

When available, 911 calls may rely on device location, network connectivity, and accurate service address information.
Wi-Fi calling availability may vary and may not function during:

  • Power or broadband outages

  • Poor Wi-Fi connectivity

Customers are strongly encouraged to maintain backup means of contacting emergency services.

11. Account Security

You must set a security PIN and protect your login credentials.
MVN-X may require authentication prior to:

  • Changing account information

  • Releasing numbers

  • Processing port-out requests

  • Handling sensitive information

Speak Easy Mobile and MVN-X are not responsible for unauthorized access caused by your failure to secure your account.

12. Limitation of Liability

To the maximum extent permitted by law, Speak Easy Mobile and MVN-X are not liable for:

  • Service interruptions

  • Delays or failures outside our control

  • Lost profits, lost data, or indirect damages

  • Actions of third-party network partners

  • Device incompatibility

Your exclusive remedy is to discontinue service.

13. Termination

We may terminate or suspend your service for:

  • Violation of these Terms

  • Fraud, abuse, or illegal activity

  • Nonpayment

  • Excessive or impermissible usage

  • Threats to network integrity

Unused balances may be forfeited if service is terminated.

14. Dispute Resolution & Arbitration

By using Speak Easy Mobile services, you agree to:

  • Resolve disputes through binding arbitration,

  • Waive your right to a jury trial, and

  • Waive participation in class-action lawsuits.

15. Changes to These Terms

Speak Easy Mobile and MVN-X may modify these Terms at any time.
Updated Terms will be posted and become effective upon publication unless otherwise required by law.

Continued use of the service constitutes acceptance of updated Terms.
